Philadelphia Squrt 43 on Ebay

Why are so many Philadelphia Squrt 43 diamond plates showing up on Ebay. I thought that until the issue of packaging was solved no more would be sold.
Should we, as collectors take any chances on buy the models from China we see on Ebay and does Code 3 encourage this type of selling of models that are no longer available directly through Code 3 ?
